1. Agreement to Terms
By accessing our website (the "Site") and using our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use our Site or services. These Terms apply to all visitors, users, and others who wish to access or use the Service.
2. Our Services
Somnaform provides custom-crafted pillows ("Products") based on information provided by you through our online consultation process. We use this data to design and manufacture a Product tailored to your specific ergonomic and comfort needs. The accuracy and completeness of the information you provide are crucial for the effectiveness of the final Product.
3. Accounts
When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. Orders, Payment, and Billing
By placing an order, you agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. All payments are processed through a secure third-party payment processor. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees.
5. 100-Night Trial, Returns, and Refunds
We offer a 100-night risk-free trial on all our custom pillows. We require customers to sleep on the pillow for a minimum of 30 nights to allow their bodies to adjust. If, between day 31 and day 100, you are not satisfied, you may initiate a return for a full refund or a one-time free adjustment. To initiate a return, you must contact our Customer Wellness Team. Products must be in a clean and undamaged condition. We reserve the right to refuse a return if the Product is found to be abused, damaged, or in an unsanitary condition. Refunds will be processed to the original payment method within 5-7 business days of us receiving the returned Product.
6. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Somnaform and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Somnaform. This includes our brand name, logo, and the proprietary algorithm used in our consultation process.
7. Disclaimer of Warranties; Limitation of Liability
Our Products are designed to improve comfort and support during sleep. However, they are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or health condition. You should consult with a healthcare professional for any medical concerns. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
IN NO CASE SHALL SOMNAFORM, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
